Surfshark’s Netherlands base is the one legitimate concern — it’s inside the 14 Eyes surveillance alliance. However, the 2025 Deloitte audit confirmed its no-logs policy holds in practice, and its RAM-only servers mean no data persists between reboots. In my view, the audited no-logs policy matters far more than jurisdiction alone.

NordVPN operates from Panama, which sits entirely outside Five/Nine/Fourteen Eyes territory. That’s a genuine privacy advantage for users who want belt-and-suspenders protection.

A note on ExpressVPN: it was acquired by Kape Technologies in 2021. Kape has had a controversial history (previously known as Crossrider, associated with adware distribution). No concerning activity has been tied to ExpressVPN since the acquisition, and its audits remain valid — but it’s something privacy-conscious users should know. Kape also owns CyberGhost and Private Internet Access (PIA).
